Jivamukti® Yoga Collective – New York – Waiver of Liability – Intake Form

1. I acknowledge and agree that I am participating in the Yoga Classes yoga, Pilates and/or Workshopsother methods of physical movement and bodywork offered by Jiva NYC, LLC, dba  Jivamukti® Yoga Collective- New York at its location at 102 Eldridge St 2B. New York, NY. 10002 (the “Studio”), during which I will receive information and instruction about yoga, Pilates and/or other methods of physical movement and related topics & bodywork. I recognize that yoga, pilates and/or other methods of physical movement and fitness activities & bodywork require physical exertion that may be strenuous and may cause physical injury or strain to myself, and I am fully aware of the risks and hazards involved. The risks include, but are not limited to, falls which can result in serious injury; injury due to negligence on the part of myself or other people around me; injury due to improper use or failure of equipment; and injury from lack of hydration.  I hereby willingly assume full responsibility for all of the risks that I am exposing myself to and accept full responsibility for any injury that may result from participating in or watching any yoga, Pilates, physical movement or bodywork activities in any of the classes, events or workshops offered by Jivamukti® Yoga Collective – New York.

 

2.   I understand that it is my responsibility to consult with a physician prior to and regarding participation in Classes, Events and Workshopsany classes, events or workshops that take place at the Studio.  I hereby represent and warrant that I am physically fit and have no medical condition which would prevent my full participation in any of the classes, events or workshops that take place at the Studio.  I promise to Jiva NY, LLC dba Jivamukti® Yoga Collective – New York that I will not participate in any activity if I am under the influence of alcohol or drugs.

 

3. In consideration of being permitted to participate in the Yoga Classes, Events or workshops that take place at the Studio, I hereby knowingly, voluntarily and expressly WAIVE AND RELEASE JIVA NYC, LLC, dba Jivamukti®  Yoga Collective – New York, its owners, officers, employees, and instructors and agents from any claim, demand, or cause of action of any kind resulting from or related to my participation in the programsany of the classes, events or workshops offered at the facility.Studio including, but not limited to, any injury or danger that I may sustain as a result of participating in any such class, event or workshop.  In taking part in the yoga classes, events, workshops, or other activities at Jivamukti® Yoga Collective – New York, I understand and acknowledge that I am fully responsible for any and all risks, injuries, or damages, known or unknown, which might occur as a result of my participation in thesuch classes, events, workshops, or other activities. I knowingly, voluntarily and expressly waive any claim against the Jivamukti®  Yoga Collective – New York for injury or danger I realize that Iiability may sustain as a result of participating in the program. I, my heir or legal representative forever release waive and covenant not to sue Jivamukti®  Yoga Collective – New York for any injury,arise from negligence or deathcarelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault.
   
   

4. I, my heirs and legal representatives forever release, waive, discharge and covenant not to sue Jiva NYC LLC, Jivamukti®  Yoga Collective – New York and any of its officers, employees, instructors and agents for any injury caused by their negligence or other acts.  
   
   

5. I also understand that some yoga classes, workshops and events may be recorded or live streamed via jivamuktiyoganyc.com or its other channels and that notification of such live streaming and recording will be prominently placed beforehand on the door outside of the studio.the room at the Studio where such live streaming or recording will take place.  By entering the room when this notification is displayed, I agree to be recorded and acknowledge that if that I do not wish to be in full view of the camera that I will set up in a designated beyond the camera view. I hereby give will thereby have given my irrevocable consent for Company Jiva NYC, LLC, dba Jivamukti®  Yoga Collective – New York to proceed with the Photography, live streaming and or recording, and, in conjunction therewith, I hereby waive, forever, as to Company Jiva NYC, LLC, dba Jivamukti®  Yoga Collective – New York, any rights of any kind, including, but not limited to, any right to privacy, publicity, compensation, copyright or other rights, now or hereafter known, that I may have to any use made of the Photography, images, or any portion thereof, or of me, my name, my personality, my likeness, my voice in connection with the Photography or images, any marketing, advertising or publicity relating thereto, or any other use Jiva NYC, LLC, dba Jivamukti®  Yoga Collective – New York may make of such photography or images in any and all media whether now known or hereafter devised. Programs (or any marketing, advertising or publicity relating thereto), or any other use Company may make of such Photography in any and all media whether now known or hereafter devised.

 

6. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigs, or transferees.  If any portion of this agreement is declared by a court of competent jurisdiction to be void or unenforceable, I agree that the rest of this agreement shall remain in full force and effect.
   

I have read the above release and waiver of liability and fully understand its contents.  I voluntarily agree to the terms and conditions of this agreement.  I understand that by signing this agreement I am waiving certain valuable legal rights.  I am legally competent to sign and voluntarily agree to the terms and conditions stated in this agreement.
